852 Golf 自助高爾夫練習室 — 使用條款及免責聲明

歡迎使用 852 Golf（下稱「本場地」）。本場地採用全自動化無人式管理，使用者在進行線上預約並獲得專屬入場 QR Code 後，即代表完全理解並同意遵守以下所有使用條款及免責聲明。

1. 入場與授權機制

  • QR Code 使用限制： 入場 QR Code 僅限預約者本人及其於預約時登記之隨行人員使用。嚴禁將 QR Code 轉讓、複製或分享予未授權之第三方。
  • 擅自闖入： 未經預約或未獲授權擅自進入本場地者，將被視為非法入侵（Trespass），本場地保留追究法律責任之權利。

2. 全天候閉路電視（CCTV）監控

  • 監控告示： 為保障使用者人身安全及場地財物安全，本場地內部及出入口均裝設 24 小時閉路電視（CCTV）錄影系統。
  • 資料使用： 進入本場地即代表同意接受 CCTV 監控。錄影畫面僅作安全防範、財物維護及爭議調查之用；如發生違規、破壞或違法事件，相關錄影將直接作為法律訴訟或警方調查之證據。

3. 設施維護、盜竊與惡意破壞之法律責任

  • 財物愛護： 使用者須妥善及正確操作場內所有設施（包括但不限於高爾夫模擬器、投影幕、測距儀、球桿、傢俬及電子設備）。
  • 惡意破壞與盜竊（零容忍政策）：

4. 人身安全與個人財物免責聲明

  • 人身安全： 高爾夫球運動具一定危險性。使用者在揮桿或使用設備時，須確保周圍無其他人員站立，並保持安全距離。因使用者自身操作不當、疏忽或違反安全指引而導致之任何個人受傷、意外或死亡，本場地概不承擔任何法律責任或賠償責任。
  • 個人財物： 使用者須自行妥善保管隨身個人物品及私家球具。本場地內無專人看護，對於任何個人財物之遺失、被盜或損壞，本場地概不負責。

5. 場地秩序與環境維護

  • 禁止違法及危險行為： 場內嚴禁吸煙（包括電子煙）、飲酒過量、使用違禁藥物、聚賭或進行任何違反香港法律之活動。
  • 環境清潔： 使用者於預約時段結束前，須將借用球具歸位，並歸還場地至原狀，隨手帶走個人垃圾。如場地留有嚴重污漬或毀損，本場地有權收取額外清潔費（最低港幣 $1,000 起）。

6. 條款修改與最終決定權

  • 本場地保留隨時修訂本條款及細則之權利，恕不另行通知。
  • 如對本聲明或條款有任何爭議，852 Golf 保留最終解釋權與決定權。
  • 本聲明受香港特別行政區法律管轄，並按其解釋。

預約取消與改期政策 (Cancellation & Rescheduling Policy)

1. 取消預約與退款安排（以 Credit 退還）：

  • 所有已成功支付及確認之預約，本場地不設任何現金、信用卡或原付款途徑之退款。
  • 如閣下於預約時間前 24 小時辦理取消程序，已繳付之費用將全數以 Credit 形式退回至閣下的個人帳戶中，供日後預約使用。

2. 更改預約時間／改期安排（自行重新預約）：

  • 由於本場地於不同時段實施不同之收費標準，系統不支援直接人工更換或對調預約時間。
  • 如閣下需要變更預約時間，請先於系統內辦理取消原預約（退還之費用將自動轉為 Credit 退回帳戶），隨後再憑 Credit 於預約系統自行選擇並重新預約新的目標時段。

3. 逾時取消與無故缺席 (No-Show)：

  • 若閣下未能在指定的提前通知期內辦理取消，或於預約時段內無故缺席，該次預約將被視為已使用，已繳付之費用將全數扣除，不獲退還任何 Credit 或款項。

優惠券使用條款及細則

  1. 本公司會不定期向顧客贈送優惠券；同時，會員帳戶每月亦會獲發價值港幣$800的優惠券。
  2. 顧客於結帳並使用優惠券支付場地/時段收費時，如優惠券之總面值不足以全數抵銷該次收費，差額部份不能以現金（或其他常規支付方式）補付。
  3. 遇上述情況，顧客必須額外購買足額的優惠券以支付全數費用，或選擇放棄於是次交易中使用優惠券，並以現金（或其他常規支付方式）全數支付整張帳單。

852 Golf — Terms of Use & Disclaimer

Welcome to 852 Golf (hereinafter referred to as "the Facility"). The Facility operates under a fully automated, unmanned self-service model. By completing an online booking and accessing the Facility using a designated QR code, you acknowledge that you have read, understood, and agreed to be bound by all of the following Terms of Use and Disclaimer.

1. Access Control & Authorization

  • QR Code Usage: Access QR codes are non-transferable and strictly restricted to the booking holder and their registered guests. Transferring, reproducing, or sharing QR codes with unauthorized third parties is strictly prohibited.
  • Unauthorized Access: Any individual entering the Facility without a valid booking or authorization will be considered a trespasser, and 852 Golf reserves all legal rights to pursue action against unauthorized entry.

2. 24/7 CCTV Surveillance

  • Surveillance Notice: For safety, security, and asset protection, the Facility is monitored 24 hours a day, 7 days a week by a Closed-Circuit Television (CCTV) system covering all internal areas and entry/exit points.
  • Consent & Usage: Entry into the Facility constitutes explicit consent to CCTV recording. Footage is recorded solely for security, safety monitoring, and incident investigation. In the event of misconduct, damage, or criminal activity, recorded footage will be submitted to law enforcement agencies (including the Hong Kong Police Force) and used as evidence in legal proceedings.

3. Asset Protection, Theft & Malicious Damage (Zero Tolerance Policy)

  • Care of Equipment: Users are required to operate all equipment and facilities (including but not limited to golf simulators, launch monitors, projectors, golf clubs, furniture, and electronic devices) in a proper, careful, and intended manner.
  • Criminal Liability for Theft & Vandalism:

4. Personal Safety & Limitation of Liability

  • Personal Safety: Golf involves inherent physical risks. Users must ensure that surroundings are clear and maintain a safe standing distance while making swings or operating equipment. 852 Golf accepts no liability for any personal injury, bodily harm, accidents, or death resulting from user negligence, improper handling of equipment, or failure to follow safety guidelines.
  • Personal Property: As an unmanned facility, 852 Golf provides no custodial services. Users are solely responsible for their personal belongings and private equipment. The Facility assumes no responsibility or liability for any lost, stolen, or damaged personal items.

5. Studio Conduct & Environmental Maintenance

  • Prohibited Activities: Smoking (including e-cigarettes/vaping), excessive alcohol consumption, drug use, gambling, or any unlawful activities are strictly prohibited within the Facility.
  • Cleanliness: Users must return all borrowed equipment and golf clubs to their designated spots, restore the studio to its original condition, and remove all personal rubbish before their booking session ends. 852 Golf reserves the right to charge a minimum cleaning fee of HK$1,000 for severe stains, disarray, or excess trash left behind.

6. Amendments & Governing Law

  • 852 Golf reserves the right to amend these terms and conditions at any time without prior notice.
  • 852 Golf retains the ultimate right of interpretation in the event of any dispute arising from these terms.
  • These Terms of Use and Disclaimer shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (HKSAR).

Booking Cancellation & Rescheduling Policy

1. Cancellation & Refund Method (Store Credit Only)

  • All confirmed bookings are strictly non-refundable via cash, credit card, or original payment methods.
  • Cancellations made prior to the required advance notice window (at least 24 hours before the scheduled start time) will be refunded strictly in the form of credit back to your user account for future use.

2. Rescheduling & Time Slot Changes (Self-Rebooking)

  • Due to variable and differential pricing structures across different time slots, direct manual time transfers or automatic rescheduling are not permitted.
  • If you wish to change your session time, you must cancel your existing booking via the platform (which will issue store credit to your account) and then manually rebook your preferred new time slot using your accumulated credits.

3. Late Cancellations & No-Shows

  • Cancellations made within the non-refundable notice window or failure to attend the scheduled session (no-shows) will result in full forfeiture of the booking fee. No credits or monetary refunds will be provided under any circumstances.

Terms and Conditions for Coupon Usage

  1. The Company may issue complimentary coupons to customers from time to time. Additionally, member accounts will automatically be credited with HKD $800 worth of coupons on a monthly basis.
  2. When using coupons to settle session/venue fees, if the total value of the applied coupons is insufficient to cover the full amount, the remaining balance cannot be settled by cash (or other standard payment methods) to make up the difference.
  3. In such instances, customers must either purchase additional coupons to cover the full session fee, or opt to pay the entire bill in full using cash (or other standard payment methods) without applying the coupons.
